HB 319 (SB 271) would expand Alabama's authority over tobacco products to include nicotine-free vapor products. The state's existing law requires manufacturers to register with the Alcoholic Beverage Control board (ABC) and prove that the products they're making are authorized by the US Food and Drug Administration. But when it comes to zero-nicotine e-liquids, the FDA's Center for Tobacco Products (CTP) doesn't have the authority to grant or deny market applications.
All of that to say that HB 319 would enact a de facto ban on 0-nicotine e-liquids without any kind of substantive product review by the state.
HB 319 is expected to be debated and possibly voted on by the full House on Tuesday, May 16. Prior to this bill hitting the floor, take action by sending a message to your lawmakers urging them to reject this obvious overreach by the state.
